Terms of Agreement
​​1. Compensation
A. A non-refundable deposit is required to secure the date of the performance. The deposit amount will be communicated by the Artist at the time of booking and will be applied toward the total fee for the event. Full payment is due prior to the performance.
B. Payment may be made via cash, credit card (with an additional 4% fee), Venmo (@chadmeersmusic), or check (made payable to "Chad Meers"). Checks must be received at least 7 days prior to the performance date.
2. Cancellation Policy
A. Client Cancellation:

If the Client cancels with more than 7 days' notice, the deposit is non-refundable.

If the Client cancels within 7 days of the event, the full agreed performance fee is due.
B. Artist Cancellation: If the Artist cancels, the Client will receive a full refund, including any deposits paid. If requested by the Client, the Artist will attempt to reschedule the performance or find a replacement artist.
3. Performance Requirements
A. The Client must provide a performance area of at least 7 feet wide x 7 feet deep, with a flat, level, dry surface and sufficient coverage (e.g., canopy or shade) to protect the Artist and equipment.
B. The Artist will provide all necessary equipment, including instruments and sound gear, and is responsible for setup and teardown.
C. The Artist’s performance fee includes one setup and one teardown per performance. Any additional requests for the Artist to tear down and relocate his equipment, whether due to weather-related circumstances, logistical changes, or any other reason, shall incur an additional fee of fifty dollars ($50) per request, payable by the Client.
D. If the event includes meal service, the Client agrees to provide a meal for the Artist. The meal should be provided during a scheduled break or prepared as carry-out after the performance.
E. After one hour of performance, the Artist will take a 10-15 minute break per additional hour of performance.
F. The Client agrees to provide a chair or stool without arms and access to bottled water.
G. Requests for specific songs or extended performance time may incur additional fees.
4. Performance Conditions
A. The Artist reserves the right to refuse to perform under any conditions deemed unsafe or uncomfortable, including but not limited to:

Severe weather conditions (e.g., rain, high winds)

Temperature exceeding 95°F or falling below 55°F

Exposure to the elements without proper coverage or shelter

Smoking on the premises

Disruptive noise or distractions (e.g., background music, loud televisions, etc.)

Unruly or inappropriate behavior (e.g., yelling at the Artist, attempting to touch him or his equipment, etc.)

Any illegal or immoral activity taking place on the premises.
B. If any of the above conditions occur, the Client or designated day-of-performance contact will be notified and must make adjustments within a timely manner. If no adjustments are made, the Artist may refuse to perform, and no refund will be issued.
5. Recurring Performances
Any recurring performances requested by the Client will be treated as separate events and are subject to the same terms unless otherwise agreed upon in writing.
6. Indemnification & Liability
The Client agrees to indemnify and hold harmless the Artist from any claims or damages arising from the event. The Artist is not liable for any injuries or property damage at the event venue.
7. Force Majeure
Neither party shall be liable for failure to perform due to events beyond their reasonable control, including, but not limited to, acts of God, war, terrorism, pandemics, government regulations, or natural disasters. If such an event occurs, the Artist will make reasonable efforts to reschedule the performance. However, if rescheduling is not possible or the event cannot take place due to the Force Majeure event, the Client agrees to pay the full performance fee, as the event has been deemed canceled due to factors outside the Artist’s control.
8. Governing Law
This Agreement will be governed by the laws of the State of North Carolina (or the state where the performance occurs).
9. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes any prior discussions or agreements. Any changes must be made in writing and signed by both parties.
